Cap-and-Invest Bill

Please note that this comment form is for the purpose of submitting a comment to the Washington State Department of Ecology on potential agency request legislation.

Under the Climate Commitment Act (CCA) in RCW 70A.65.210, the Legislature directed Ecology to consider linkage of Washington’s carbon market with the joint carbon market of California and Québec. On Nov. 2, the Director of Ecology announced a preliminary decision to pursue linkage. Ecology will need to submit agency request legislation to amend provisions of the CCA. The potential bill being considered would include changes to the statute that may be necessary to allow linkage, as well as potential provisions to address other issues with the CCA. Parts of the law that might be proposed to be amended include, but are not limited to, provisions concerning allowance purchase limits, electricity markets, and offsets. During this evaluation and conversations with stakeholders, other statutory amendments, including some that are not related to linkage, might be identified.
